Grand jury will hear poisoning case

ELMIRA, N.Y. -- The case involving an Elmira woman accused of killing her 21-month-old stepson is headed to Chemung County Court.

The boy was born in Batavia.

24-year-old Melissa Engelhardt’s preliminary hearing was waived in Elmira City Court Tuesday.

Engelhardt was arrested last week following a four month investigation.

Investigators say she poisoned her stepson, Andrew John Cianfrini, last November.

She was originally charged with first-degree manslaughter.

A Chemung County grand jury will now decide if any additional charges will be filed against her.

"It could go either way. There’s going to be an issue of intent. Her professed intent was that she did not want to kill the child but that simply wanted to make the child sick,” said Chemung County Assistant District Attorney John Thweatt. “Obviously, the way she attempted to do that was clearly very callous, very reckless and the child ended up dying because of it."

The Batavia Police Department assisted in the investigation because there was some question as to whether Cianfrini was poisoned in Batavia or Elmira.

The child was buried in Batavia where his mother and grandparents still live.
