Pedestrians suing town, state, driver that hit them

LOCKPORT, N.Y. — A year after being hit by a car on Dysinger Road in the town of Lockport, two residents have filed a lawsuit against the town, state and the resident who struck them with his car.

Sherman Carson and Danielle Boston were hospitalized last August after a Lockport man hit them with his car on Dysinger Road.

In a new lawsuit, Carson and Boston claim the road was "designed and maintained in an unreasonable safe condition."

The lawyer representing the two says its time the state and town come together to fix the troubling stretch of road.

“Ultimately, it's our hope that the roadway is made safer for pedestrians and for the residents of Dysinger Road. That's ultimately what we'd like to see happen, because short of a lawsuit, nobody seems in any rush to change anything,” said Stephen Cioccia.

A call to the Town of Lockport attorney was not returned Thursday. The road has been at the center of concern for some time.

Last month, Senator George Maziarz met with DOT officials to survey the road and discuss the dangers drivers face.
